DMCA Policy for Pumpkin Cheesecake

Pumpkin Cheesecake ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) of 1998, the text of which can be found on the U.S. Copyright Office website, we will respond expeditiously to claims of copyright infringement committed using the Pumpkin Cheesecake service and website (the "Site") if such claims are reported to our designated Copyright Agent as described below.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability.

Filing a DMCA Takedown Notice

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Takedown Notice and delivering it to our designated Copyright Agent.

  1. Identification of the copyrighted work claimed to have been infringed: Provide a description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works. Include details such as the title, author, and any registration numbers if available.
  2. Identification of the material claimed to be infringing: Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access disabled, and information reasonably sufficient to permit us to locate the material (e.g., URL(s) on the Pumpkin Cheesecake website).
  3. Contact information of the complaining party: Provide your mailing address, telephone number, and, if available, an email address.
  4. A statement of good faith belief: Include a statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information is accurate: Include a statement that the information in the notification is accurate, and under penalty of perjury, that you are the owner, or authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.

Filing a DMCA Counter-Notification

If you believe that the material you posted on the Site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our designated Copyright Agent. To be effective, a counter-notification must be a written communication provided to our designated Copyright Agent that includes substantially the following:

  • Identification of the material removed: Identify the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., URL(s) on the Pumpkin Cheesecake website).
  • Statement under penalty of perjury: A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Subscriber's contact information: The subscriber's name, address, and telephone number.
  • Consent to jurisdiction: A statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the subscriber's address is outside of the United States, for any judicial district in which Pumpkin Cheesecake may be found, and that the subscriber will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
  • Subscriber's signature: The subscriber's physical or electronic signature.
  • Deliver the counter-notice: Send the completed DMCA Counter-Notification to our designated Copyright Agent at the address provided in the "Filing a DMCA Takedown Notice" section above.
